1. Introduction
These Terms of Service ("Terms") govern your use of the services provided by Elitehost Cloud Limited ("we", "us", "our"), a hosting provider operating in Kenya. By ordering or using our services, you agree to these Terms.
2. Services
We provide shared hosting, WordPress hosting, VPS, cloud hosting, dedicated servers, reseller hosting, domain registration, and related services as described on our website and in your order.
3. Payment
Invoices are payable via M-Pesa, PesaPal, or other methods shown at checkout. Payment is due by the date shown on your invoice. Services may be suspended for non-payment after the due date, and repeated non-payment may result in service termination and data removal.
4. Acceptable Use
You may not use our services to host illegal content, distribute malware, send unsolicited bulk email (spam), infringe on intellectual property rights, or engage in any activity that disrupts our network, servers, or other customers. We reserve the right to investigate suspected violations and take appropriate action.
5. Account Suspension & Termination
We may suspend or terminate services for violations of these Terms, non-payment, or abuse of our infrastructure. Where reasonably possible, we will provide notice before taking action. Data associated with terminated accounts may be permanently deleted after 30 days.
6. Domain Registrations
Domain registrations are subject to the policies of the relevant registry (e.g. KENIC for .co.ke and .ke domains). You are responsible for keeping your contact and payment details up to date to avoid unintended domain expiry.
7. Service Availability
We aim for high uptime across our hosting infrastructure but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.
8. Limitation of Liability
Services are provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of our services, including loss of data, revenue, or business opportunities.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of Kenya, and any disputes will be subject to the jurisdiction of Kenyan courts.
